Artificial intelligence, cryptography, decentralized networks, and digitally native systems are changing more than the tools we use. They are changing the architecture through which information is controlled, decisions are made, identity is established, value is transferred, and trust is created.
These changes raise questions that extend beyond technology.
Who controls the infrastructure?
Who controls the data?
Who controls the intelligence derived from it?
What does ownership mean when legal rights and technological control no longer perfectly align?
Where does trust reside when institutions are replaced, supplemented, or constrained by software, networks, and cryptographic verification?
And what happens to individual and institutional agency when participation increasingly depends on systems we cannot independently inspect, operate, modify, or leave?
These are questions of technology, but they are also questions of law, governance, power, and sovereignty.
Sovereignty & Law is an ongoing Lex Wire Journal editorial initiative examining this emerging intersection.
The project explores how technological systems can redistribute control among individuals, institutions, corporations, governments, and networks, and what those changes may mean for lawyers, legal institutions, businesses, and society.
It does not begin with the assumption that decentralization is inherently superior to centralization, that technological control should replace legal authority, or that emerging technologies will inevitably produce greater individual freedom.
It begins with a question:

About the Initiative

Sovereignty & Law is a Lex Wire Journal editorial initiative founded and led by Jeff Howell, founder of Lex Wire Journal and a former corporate attorney.
The initiative brings together research and analysis across law, artificial intelligence, cryptography, decentralized systems, institutional governance, digital ownership, and emerging technological infrastructure.

The Problem of Digital Dependence
Modern life increasingly depends on digital systems operated by third parties. Individuals and institutions rely on cloud infrastructure, artificial intelligence, software platforms, communication networks, digital identity systems, and financial technologies to store information, make decisions, conduct business, communicate, and exchange value.
Dependence itself is not necessarily a problem. Complex societies have always depended on specialized institutions and shared infrastructure. The more important question is what happens when dependence becomes inseparable from control.

What Does Sovereignty Mean in a Technological System?
Sovereignty is traditionally associated with states, governments, and political authority. But digital systems introduce another dimension to the question of control.
Increasingly, the practical ability of an individual or institution to act depends on technological infrastructure: the systems that hold information, verify identity, process transactions, facilitate communication, execute decisions, and generate intelligence.
This raises a fundamental distinction between having permission to use a system and having meaningful agency within it. Access can be granted, restricted, priced differently, modified, or withdrawn. Control asks a different question: what capabilities remain when permission from an intermediary is no longer assumed?
Access is not the same as agency.
A person or institution may have extensive access to data, software, infrastructure, or intelligence while remaining dependent on another party for the continued ability to use it.
From this perspective, technological sovereignty is not simply about owning hardware, avoiding cloud services, or decentralizing every system. Nor does sovereignty require complete independence from other people or institutions.
The more useful inquiry is whether individuals and institutions retain sufficient agency, control, portability, verification, and freedom of exit to make meaningful choices about the technological systems on which they depend.

A Framework for Sovereignty & Law
The relationship between technology and sovereignty cannot be understood through a single question of ownership or control. It emerges from the interaction of several underlying concepts that determine what individuals and institutions can actually do within a technological system.
Sovereignty & Law uses the following concepts as a framework for examining how technological architecture can shape rights, relationships, institutional power, and the practical ability to act.
Agency
The practical capacity to make choices and act upon them. Technology can expand agency by creating new capabilities, but it can also constrain agency when meaningful action depends on permission from systems controlled by others.
Control
The ability to determine how a resource, system, or capability is used. Technological control and legally recognized authority may overlap, but they are not always identical.
Ownership
The legal and practical relationship between a person or institution and an asset, resource, or body of information. Digital systems increasingly test the relationship between formal ownership and effective control.
Trust
The reliance placed on people, institutions, processes, or technological systems to behave as expected. New technologies can change not only how trust is established, but where trust must be placed.
Verification
The ability to independently confirm information, identity, transactions, rules, or system behavior. Verification can reduce reliance on representations made by trusted intermediaries without eliminating trust entirely.
Portability
The ability to move information, assets, identity, or capabilities between systems. Portability can determine whether the theoretical freedom to leave a platform or provider exists in practice.
Exit
The practical ability to leave a system without losing essential information, assets, identity, functionality, or institutional continuity. The existence of alternatives matters only when they can realistically be used.
Architecture
The technical structure through which permissions, dependencies, verification, and control are distributed. Architecture matters because the design of a system can influence who possesses power within it.
Sovereignty
The degree to which meaningful agency and control can be preserved within relationships of technological dependence. In this inquiry, sovereignty is not treated as complete independence, but as a question of how much meaningful authority remains with the individual or institution.
The central question is not whether we depend on technology.
It is how technological dependence distributes agency, control, trust, and power, and whether the people and institutions using those systems retain meaningful alternatives when those interests diverge.

The questions raised by technological sovereignty extend across artificial intelligence, data, cryptography, decentralized networks, digital identity, monetary systems, institutional governance, and the infrastructure through which modern organizations operate.
As these systems evolve, Sovereignty & Law will examine not only what new technologies make possible, but how their underlying architectures distribute authority, dependency, risk, and control.
The objective is not to advocate for a single technological model. It is to develop a clearer framework for understanding what happens when legal rights, institutional authority, and technological power no longer reside in exactly the same places.
As technology changes the architecture of power, law will increasingly have to confront not only who has rights, but who has the practical ability to exercise them.
