    From document review and research to client intake and predictive analytics, AI is reshaping legal workflows across the country. But how do we use these tools without running afoul of confidentiality rules, malpractice exposure, or professional responsibility requirements?

    Five Core Risks to Know (and Mitigate)

    Jeff outlined five key risk categories attorneys must address when integrating AI into legal work:

    1. Bias in Machine Learning Models

    AI often learns from biased historical data—leading to:

    • Discriminatory sentencing predictions

    • Unequal treatment based on demographics

    • Inaccurate assessments in criminal or civil risk models

    What to Do: Test outputs across diverse hypotheticals. Document review procedures. Train staff to recognize biased patterns.


    2. Hallucinations and Inaccurate Citations

    Generative AI tools can confidently produce legal citations that don’t exist. In a notable New York case, attorneys were sanctioned for submitting a brief filled with fake ChatGPT-generated case law.

    What to Do: Always verify every citation using trusted legal databases. Assume AI will get some things wrong, until proven otherwise.


    3. Confidentiality Breaches

    Public AI platforms often store or use submitted inputs to train their models. If you’re uploading sensitive case files or client data, you could be violating Rule 1.6 of the ABA Model Rules, even unintentionally.

    “Don’t hit ‘generate’ and walk away,” said Jeff Howell, Esq. “You’re still the lawyer. AI is just a very persuasive intern, with no law degree.”


    Rule 1.6 – Confidentiality

    Anything you input into a cloud-based system must be secured. Review privacy policies and ensure your client’s data won’t be stored, shared, or used for training.


    Rule 5.1 and 5.3 – Supervision

    If junior attorneys or staff use AI tools, you are still ethically responsible for their conduct, and the tool’s output.

    Include clear guidelines on:

    • Which tools are approved
