What Every Attorney Needs to Know About Generative AI in Legal Research

By Jeff Howell, Advocate for Ethical AI in Law

Speed and synthesis with real risks attached. Use AI to accelerate research without risking sanctions, privilege, or your license.

Generative AI has exploded into legal practice. Tools like ChatGPT, CoCounsel, and Harvey can summarize precedent, outline arguments, and surface authorities in minutes. Used the wrong way, they can also invent cases, misstate holdings, and expose confidential information. This guide covers the upside, the pitfalls, and the policies that let you use AI effectively and ethically.
“AI won’t replace lawyers, but lawyers who understand AI will replace those who don’t.”  Jeff Howell, Esq., Lex Wire

The Upside: Where AI Actually Helps

    • Rapid synthesis: draft issue lists, outlines, and competing theories.
    • First-pass surveying: identify potential authorities to check in primary sources.
    • Leveling effect: solo and midsize firms gain leverage against larger teams.
    • Legal-tuned options: platforms like CoCounsel/Harvey are trained on vetted legal data and workflows.

The Three Big Risks (and How to Control Them)

    1) Hallucinations

LLMs can produce confident but false citations or misstate holdings.
    • Control: treat outputs as leads, not law. Verify every cite in primary sources. Require attorney sign-off.

    2) Privilege & Confidentiality

Pasting client facts into public tools can waive privilege or breach duties.
    • Control: use approved vendors with DPAs; keep sensitive facts in secured, logged environments; add client-facing guidance.

    3) Overreliance Without Verification

Model Rule 5.3: you can delegate tasks, not responsibility. AI errors are still your errors.
    • Control: require cite checks, docket checks, and human review before anything reaches a court or client.

    Responsible Use: A Simple Playbook

    1. Use AI for drafts, not finals. Let it outline and summarize; you confirm the law.
    2. Prefer legal-specific platforms. Use tools trained on vetted legal corpora when possible.
    3. Keep client data out of public tools. If it’s identifiable, it stays in your secured workspace.
    4. Document policy & training. Show regulators and carriers you have guardrails and logs.

    Compliance and Visibility Are Connected

Authority signals that protect you include structured citations, CLEs, press, and attorney-authored analysis, which also make your firm more likely to be cited by AI search engines. Responsible practice strengthens both risk posture and market visibility.
“Blogs alone won’t cut it. Structure, corroboration, and compliance are what make you safe to cite.”  Jeff Howell

    Frequently Asked Questions

Can I cite AI in a brief?

Don’t cite AI as an authority. Use it to brainstorm and draft, then cite primary sources you personally verified.

Are legal-specific tools “safe” by default?

Safer, but not foolproof. Confirm data handling (DPA), disable training on your inputs, and still verify all outputs.

What belongs in our AI policy?

Approved tools, vendor DPAs, prompt/data rules, verification steps, logging, and role-based responsibilities.

How do we prevent staff from using public tools?

Provide a secure alternative, train on risks, and enforce access controls with periodic audits.

    Where should we start?

Create a short research workflow: AI draft → attorney verification checklist → cite check → final memo. Then expand to other use cases.
